Positive Discrimination as a Guarantee of Equality for Homosexuals

Resumo: The article analyzes the legal discrimination designed to achieve equality between individuals, as decisions judicial favorable to homosexuals and the law projects that aim to give them effective guarantee of their rights. To this end, we studied the origin of homoafetividade, the importance of the constitutional principles for the edification of the rights, the right to freedom of sex and the advances in the jurisprudential sense of recognition of rights of homosexuals. The work was structured on the basis of the methodology hypothetical-deductive, and the study was developed through research, doctrinal foundations laws and jurisprudence.

Para tanto, foram estudados a origem da homoafetividade, a importância dos princípios constitucionais para edificação dos direitos, o direito à liberdade de sexo e os avanços jurisprudenciais no sentido de reconhecimento de direitos dos homossexuais.
