Resumo: The homoaffective union is a reality that cannot be ignored. In fact, it must be protected by law on behalf of the following principles: dignity, isonomy, sympathy, liberty and affectivity. If the homoaffective relationship is public and if it goes on for long years, there is no need of mentioning sex, because the affectivity is the most important thing in family entities. The law disposals of stable union can be applied to homoaffective union in order to provide legal rights – such as adoption, succesory rights – for partners.

Si ocurra la prueba de que el reracionamiento homoafectivo es duradero, público y continuo, formando un núcleo familiar, no hay que hablarse en sexo, porque es la afectividad que impera en la relaciones familiares debiendo ser aplicados los mismos dispositivos de la unión estable, concediendo derechos cuanto a la prestación de alimentos entre las parejas, repartimiento de bienes, derecho sucesorio, adopción, entre otros.A união homoafetiva é uma realidade que não pode ser ignorada e que merece a tutela jurídica em decorrência dos princípios da dignidade da pessoa humana, da isonomia, da solidariedade, da liberdade e da afetividade.
