Devido à expansão da tecnologia, o ciberespaço, com as redes sociais, vem desenvolvendo forte influência no âmbito social e jurídico, desencadeando graves incongruências hermenêuticas interpretativas. As ilimitações das redes sociais, somado ao desconhecimento da lei e ao caráter público da maioria dos processos, podem desencadear violações constitucionais e decisões judiciais contrárias à própria lei, tendo em vista que a força da comoção social, através da mídia, pode intervir na formação da convicção dos magistrados e, consequentemente, no poder judiciário. Entender os impactos que as incongruências hermenêuticas, expostas no ciberespaço, geram nos procedimentos judiciais, é de suma importância para se verificar até que ponto o Poder Judiciário é capaz de cumprir sua função constitucional, percebendo que existem limitações relevantes que não podem ser ignoradas. Neste contexto, convém investigar como o ciberespaço pode se tornar uma via de mão dupla e dilatando a divergência de opiniões jurídicas sem fundamentos legais, gerando um descontrole hermenêutico, na mesma medida em que proporciona uma vasta disponibilidade de informações jurídicas. Para tanto, a presente pesquisa se baseou em estudos bibliográficos, bem como na análise da legislação em vigor, associada ao estudo de casos e análise do comportamento social midiático. Como resultado, verificou-se que, em que pese o ciberespaço fomente uma diversidade de incongruências hermenêuticas interpretativas no âmbito jurídico, se utilizado adequadamente, poderá fomentar grandes vantagens aos processos judiciais. Due to the expansion of technology, the cyberspace, along with social networks , has been developing a strong influence in the social and legal spheres, triggering serious interpretive hermeneutical inconsistencies. The limitations of the social networks, added to the lack of knowledge of the law and the public nature of most cases, can trigger constitutional violations and judicial decisions contrary to the law itself, given that the force of social commotion, through the media, can intervene in the formation of the conviction of the magistrates, and consequently, in the judiciary. Understanding the impacts that the hermeneutical incongruities exposed in cyberspace generate on judicial procedures is of a great importance to verify the extent to which the Judiciary is able to fulfill its constitutional function, realizing that there are relevant limitations that cannot be ignored. In this context, it is important to investigate how the cyberspace can become a two-way street, in which the divergence of legal opinions without legal foundations expands, generating a hermeneutic lack of control, in the same way that it provides a wide availability of legal information. Therefore, the present research was based on bibliographic studies, as well as on the analysis of the legislation in force, associated with the study of cases and analysis of social media behavior. As a result, it was found that in spite of cyberspace fostering a diversity of hermeneutical interpretative inconsistencies in the legal scope, if used properly, it can promote great advantages to judicial processes.
