Pragmatic Twist of the Linguistic Turn and Outlines of a New Legal Hermeneutics

This article aims to demonstrate need to reestruturate de legal hermeneutics, adjusting it to the current language paradigm. Thus, through literature review, it discusses about the paradigms of knowledge: starts from the search for essences, in paradigm of being, passing through so-called " subjugated subject" in the philosophy of consciousness, reaching the paradigm of inter-subjectivity, which aligns theory and practice and reformulates the function of language - it ceases to be purely designating element to pass the condition of possibility of knowledge. It discusses the influences of the latter paradigm for the "how" of hermeneutics, aiming to demonstrate the adoption of this new paradigm requires the reformulation of key concepts of traditional hermeneutics, including distinguishing between text and norm and how to face the phenomenon pre-understanding. Exploring these concepts, analyzes, at the end, what is the law: "What the judges say" or "what the law says." It concludes claiming law is not "what the judges say" neither "what the law says", but a third way that recognizes the need for interpretation and, the same time, compliance with the legal limits and respect for tradition.
