Resumo: The study of Brazilian constitutions shows that culture was superficially treated in its constitutional approach, at first through freedom of speech, in which the state shouldn’t scrimp. Gradually the Brazilian state began to feature in the promotion of access to culture, stopping to appear simply as a "helper", "animator ", or just as "protector". In the 1988 Constitution, it is seen substantial expansion of the state's role in the development of public policies for recovery, access, protection, encouragement of culture, a role that has suffered considerable consolidation due to the following constitutional amendments.

Aos poucos o Estado brasileiro passou a protagonizar a promoção do acesso à cultura, deixando de aparecer como “amparador”, “animador”, ou apenas como “protetor”.
