Resumo: The work by doctrinal analysis seeks to demonstrate the essentiality of fundamental rights in a democratic state, in which individuals, rather than subjects of rights, are social actors call for a legitimate and efficient legal system, with capacity to enable the social welfare provided in the Federal Constitution. In particular, the purpose is to analyze, through the logicaldeductive method, the right to housing as a right to life with dignity and show the State's obligation in the implementation of public policies for an inclusive and just society, as defended by Jürgen Habermas, with the Theory of Communicative Action.
