Resumo: It is common ground in modern civilization that the work is a factor of human achievement and social development, fundamental to a dignified life. To be essential to the realization of other human rights, States committed to social welfare must prioritize the right to work, striving not only in enabling job opportunities, while ensuring that it can exercise it worthily. Starting from these premises, this research aims to discuss the right to work in the list of fundamental guarantees within the democratic rule of law, and specifically in the Constitution and the role of the state in its execution
