Strategic use of Fundamental Principles in the Company: Apple Case Analysis Under the Brazilian Law

Resumo: The article deals with whether or not a company refuses to comply with a request of Brazilian police, to develop software that eliminates the security encryption of their products, even before the investigation of a terrorist act, as happened with Apple in the United United. In Brazil, from a principled analysis, there is not mentioned in the imposition of the fundamental principle of individual freedom and confidentiality of personal data, given the apparent violation of other fundamental principles aimed at protecting and ensuring the effectiveness of assets more relevant.
