Resumo: | The labor in outsourcing is an exceptional legal regime, highly used in Brazilianand Spanish practice. The problem is the worst working conditions to which workers may be exposed to service companies, most instability and difficulty finding responsible,for example, in cases of conflicts in occupation al health. While inSpain the reason important legal development of the phenomenon, achieving equal rights and benefits of employees of service companies in Brazil there is no legal, fulldevelopment of the subject for the moment, solucionándose conflicts through established jurisprudence of the Superior Labour Court. This letter is intended to high light the weaknesses of the current Brazilian system taking as parameter the development of the Spanish system. |

Mientras que en España hay un importante desarrollo legal del fenómeno, logrando una equiparación de derechos y beneficios de los trabajadores de empresas prestadoras de servicios, en Brasil no existe un desarrollo legal, completo del tema por el momento, solucionándose los conflictos a través de la jurisprudencia consolidada del Tribunal Superior de Trabajo.
