Resumo: The aim of this paper was to analyze the extent to which bioethics committees could serve as prior instances of the judiciary, thus preventing the legalization of conflicts involving the issue and to examine in more complex cases they could serve as specialized legal assistants. The theory of general and legal argument was presented as able to offer greater objectivity procedure to bioethical deliberations, thus allowing a greater part by rationality control of those who are not part of them.
