Socioenvironmentalism and Nature 's Rights in Latin American Integration for Good Lives

Resumo: The proposed of reconstruction of legal, economic, political and social instability in the countries of South America necessarily permeates an analysis of movement enshrined by the New Latin American Constitutionalism Democratic founded on the idea of   buen vivir. The exhaustion of the Continental-European neoconstitucional model in South America is evident primarily from the Constitution of Ecuador (2008) and the Constitu- tion of Bolivia (2009), quite innovative in terms of political and democratic relationships, the result of this constitutional motion. They are seeking a more participatory democratic model, inclusive, egalitarian and horizontal in the relationship between citizens and the state. In light of this new legal-political phenomenon becomes urgent revision of tradi- tional concepts that permeate socioenvironmentalism, the rights of nature and partici- patory democracy. Legal recognition of nature as a subject of dignity and rights requires rationality and sensitivity of lawyers and implies an epistemological reinterpretation of the recognition of dignity and rights for all living beings, since, from the anthropocentric view - European cartesian matrix, these features were reserved only to humans for the effectiveness of Latin American integration project for the good living.

O esgotamento do modelo neoconstitucional europeu-continental na América do Sul torna-se evidente principalmente a partir da Constituição do Equador (2008) e da Constituição da Bolívia (2009), bastante inovadoras no plano das relações políticas e democráticas, fruto desse movimento constitucional, buscam um modelo democrático mais participativo, inclusivo, paritário e horizontal na relação entre os cidadãos e o Estado. À luz desse novo fenômeno jurídico-político torna-se premente a revisão dos conceitos tradicionais que permeiam o socioambientalismo, os direitos da natureza e a democracia participativa.
