Resumo: | The work deals with the moral harassment suffered by workers in their work environment and the main objective is to develop the theme moral harassment in employment relationships, it is to awaken the employer class and make workers aware of the harmful effects caused by moral harassment in the workplace. work. The topic is little discussed and, most of the time, the harassed worker endures in silence, extremely vexing situations due to his need for work, understood as his livelihood and that of his family. It is intended to demonstrate the context of moral harassment in the employment relationship, the subjects of this relationship and especially the powers attributed to employers, who often go beyond their limits and cause the practice of moral harassment in work organizations. We will also approach the very personal right, which has as elements the personality of its holder in its physical, moral and intellectual aspects. Personality rights are born with the person and accompany them throughout their life trajectory, with the objective of protecting the essential qualities and attributes of the human person, in order to safeguard their dignity and protect them from aggression, being the responsibility of the tutelary State. and legally sanction this right. It points out the classification, legal nature and especially the principle of human dignity, constitutional foundation, under the aspect of the worker, and the aggression to dignity occurred in the work environment. After characterizing the moral harassment suffered by the worker, the moral damage resulting from this harassment, its legal nature, characterization, competence of the Labor Court and the difficult task of the Judge of Law in establishing the value resulting from this indemnity, which is the compensation for the harassment suffered; the tool to rescue the dignity of the employee. |

O tema é pouco discutido e, na maioria das vezes, o trabalhador assediado suporta em silêncio, situações extremamente vexatórias em razão de sua necessidade de trabalho, compreendida como seu sustento e de sua família. Pretende-se demonstrar o contexto do assédio moral na relação de emprego, os sujeitos dessa relação e principalmente os poderes atribuídos aos empregadores, que por muitas vezes extrapolam seus limites e causam a prática do assédio moral nas organizações de trabalho. Abordaremos também o direito personalíssimo, que tem como elementos a personalidade do seu titular em seus aspectos físico, moral e intelectual. Os direitos da personalidade nascem com a pessoa e a acompanham durante toda sua trajetória na vida, tendo como objetivo à proteção das qualidades e dos atributos essenciais da pessoa humana, de forma a salvaguardar sua dignidade e protegê- la de agressões, cabendo ao Estado tutelar e sancionar juridicamente esse direito. Aponta-se a classificação, natureza jurídica e principalmente o princípio da dignidade humana, fundamento constitucional, sob o aspecto do trabalhador, e a agressão à dignidade ocorrida no ambiente de trabalho.
