Direitos fundamentais, Big Data e inteligência artificial: dilemas éticos, possíveis maneiras de regulação e o pioneirismo da União Europeia

The increasing implementation of Artificial Intelligence (AI) in diversified fields of knowledge and in the day-to-day life has a disruptive potential not often experienced throughout history. This technological tool already presents itself as a stimulant of the global economy and can change the way human relationships take place. Even though it can present positive factors regarding the improvement in quality of life, the AI can also promote various impacts on fundamental rights, constituted through specific social claims. In addition, given its recent deployment, a conceptualization of terms is necessary, to comprehend not only what Artificial Intelligence is, but also how it relates with Big Data, as well as its connection with other technological mechanisms, such as Machine Learning and algorithms. Therefore, through a bibliographic review of books, research and academic papers produced on the subject, this work seeks to understand the ethical dilemmas and violations that artificial intelligence can produce in fundamental rights, considering the nonstop development of AI and its restriction to specific highly specialized groups. Finally, this work approaches the discussion about possible manners to regulate AI turning to the leading role of European Union (EU), noting also intersection points between the General Data Protection Regulation (2016) of EU and the mitigation of violations generated by the technological tool in the fundamental rights.
