Resumo: DOWN SYNDROME AND THE RIGHT TO EDUCATION seeks to provide a necessary reflection on the educational rights of individuals who, in their conception, have undergone a chromosomal alteration in the DNA, highlights relevant aspects of school inclusion, the issue surrounding the educational process and the protection of the main norms in force in the Brazilian legal system. For a better understanding of the theme, the work was developed based on bibliographic research, courts and entities representing Down syndrome, in addition to a structured interview directed to parents, educators and therapists. This monograph in its first chapter explains what Down syndrome is and how it occurs, in addition to addressing its origin, main characteristics, etiology, diagnosis and statistics. In the second chapter, it demonstrates the main protective rules in force in the legal system, which guides Special Education in Brazil. In the third chapter, we report the difficulties encountered in the literacy process, the importance of inclusion and the specialized professional within the classroom, in addition to demonstrating the perspectives of those involved and the understanding of the courts of the state of São Paulo. In the end, what is expected is to conclude that these people are able to learn to read, write and develop, as long as their time and limitations are respected, applying appropriate specialized resources, so that all these achievements are directed, so that they can effectively be inserted into society, either for the sake of their own future or for the sake of that very society in the future.

Ressalta aspectos relevantes na inclusão escolar, na problemática que envolve o processo educacional e a proteção das principais normas vigentes no ordenamento jurídico brasileiro. Para uma melhor compreensão do tema, o trabalho foi desenvolvido com base em pesquisas bibliográficas, decisões de tribunais e entidades representativas da Síndrome de Down, além de entrevista estruturada direcionada aos pais, educadores e terapeutas. Esta monografia em seu primeiro capítulo, explica o que é, e como ocorre a síndrome de Down, além de abordar sua origem, principais características, etiologia, diagnóstico e estatísticas. No segundo capítulo, demonstra as principais normas protetivas vigentes no ordenamento jurídico, que norteiam a Educação Especial no Brasil. No terceiro capítulo, relata-se às dificuldades encontradas no processo de alfabetização, a importância da inclusão e do profissional especializado dentro da sala de aula, além de demonstrar as perspectivas dos envolvidos e o entendimento dos tribunais do estado de São Paulo.
