The present study was delimited by the theme “human rights, religious freedom and conscientious objection”. Inthe order to establish dialogue about secularity principles, religious freedom and abuse of power, in the religious modality. Have in mind the generated controversy by this theme, mostly, in the past years. This research, was been effected, from the historical method, to analyze about: how the first concept was called on the beginning, were applied this concept in the past and how are the currently seen about that. In the evolution process, It was analyzed since antiquity, how the themes are seen by researchers, going to conceptual analysis about the brazilian constitutionalism recept. Finaly, it was observed the recents events in the national policy. Then, was seen about special resource nº 82-85.2016.6.09.0139/GO, that clearly, result in awakening about this theme, being judge by Superior Electoral Court of Brazil, will can change the relationship about religion and the policy. At last, have been observed, the limits in the relation about this two social areas, seeks the understanding of the factors above the religion and policy and what those circunstances which divide them. As is it shown above, in the end has been tried answer the question: how is the juridical relation between democratic state and religious participation in the civilian society?
