Resumo: The present work aims to critically present the novel Institute of Confisco Alargado (art. 91-A, Brazil's Penal Code). The context for introducing this effect of the conviction and the Expansion of Criminal Law is the Society of Risks. Through a literature review and document analysis, with a predominantly dogmatic focus, the conclusion is reached that it would not be legitimate, appropriate and necessary to extend the loss of assets in the Brazilian legal system, as an effect of the conviction, for assets that have no relation to an imputation criminal. To carry out the research, Karl Popper's hypothetical-deductive method is adopted.

O contexto de introdução desse efeito da sentença condenatória e a Expansão do Direito Penal é a Sociedade de Riscos. Por meio de revisão bibliográfica e análise documental, com enfoque predominantemente dogmático, chega-se à conclusão de que não seria legítimo, adequado e necessário o alargamento da perda patrimonial no ordenamento jurídico brasileiro, como efeito da condenação, para bens que não tenham correlação com a imputação criminal.
