Resumo: This article aims to clarify the importance of understanding the discipline of punishment (“execution of criminal sanctions”- criminal enforcement) or similars in the Brazilian law universities from the exposure of the changes observed in the treatment of the matter,having as parameter the promulgation of the Brazilian’s Constitution (1988). The indispensable pillars of the subject will be clarified to give autonomy to a particular legal discipline as well as a critical analysis about the observance of them at this stage. Next will be discussed some topics that are fundamental to a comprehensive understanding of the subject, and that should be taught in the classroom, based on court experience.

O presente artigo visa situar a importância da compreensão da disciplina “Execução Penal” ou similares nas faculdades de Direito brasileiras a partir da exposição das mudanças verificadas no tratamento da matéria, tendo como parâmetro a entrada em vigor da Constituição Federal de 1988. Serão esclarecidos os pilares indispensáveis para seconferir autonomia a essa determinada disciplina jurídica, bem como uma análise crítica acerca da observância desses pressupostos no estágio atual. Em seguida, serão abordados alguns tópicos que são fundamentais para uma compreensão abrangente do assunto, e que deveriam ser ensinados em sala de aula, com base na experiência forense.
