The Superior Court of Justice and the protection of the family asset: judicial activism or preservation of minimum heritage?

Resumo: The purpose of this article is to discuss the modalities of Family Good, admitted in the Brazilian legal system, either through the legal or jurisprudential way. The investigation starts from a historical bias, starting from the premises that the principles of the dignity of the human person and the minimum patrimony, recognized, above all by Luiz Edson Fachin, are recognized in the organization itself. The article presents a brief analysis of the position of the STJ Judges, in order to know if, in cases of decisions related to the Family Welfare, this court had an activist stance or preservation of the minimum patrimony. The research adopted the methodology of bibliographic review to raise the state of the art, as well as the jurisprudential review to evaluate how the courts decide, concluding about the existence or not of judicial activism.

La investigación se inicia a partir de un sendero histórico, partiendo de las premisas de que se reconocen en el propio ordenamiento los principios de la dignidad de la persona humana y del patrimonio mínimo preconizado, sobre todo por Luiz Edson Fachin. El artículo ofrece un breve análisis de la posición de los juzgados del STJ con el fin de conocer si, en los casos de decisiones relacionadas con el Bien de Familia, este tribunal ha adoptado una postura activista o de preservación del patrimonio mínimo. La investigación adoptó la metodología de la revisión bibliográfica para levantar el estado del arte, así como la revisión jurisprudencial para evaluar cómo deciden los Tribunales, concluyendo sobre la existencia o no del activismo judicial.O objetivo deste artigo é discutir as modalidades de Bem de Família, admitidas no ordenamento jurídico brasileiro, sejam pela via legal ou jurisprudencial. A investigação é iniciada a partir de um viés histórico, partindo das premissas de que é reconhecido no próprio ordenamento os princípios da dignidade da pessoa humana e do patrimônio mínimo, preconizado, sobretudo por Luiz Edson Fachin. O artigo apresenta breve análise sobre o posicionamento de julgados do STJ, a fim de conhecer se, nos casos de decisões relacionadas ao Bem de Família, esse tribunal teve postura ativista ou de preservação do patrimônio mínimo.
