Who are Public Defenders in Brazil? Profiles and trajectories from 2004 to 2017

Resumo: This article seeks to study a specific group of legal professionals in Brazil: the publicdefenders at the state and federal level. These professionals acquired great relevance afterthe 1988 Federal Constitution, as promoters of fundamental rights of large groups of theBrazilian population. Groups that have always had difficulties regarding the access to theinstitutions of justice system – for reasons such as insufficient financial resources. Thisstudy presents the social and work profiles of the current public defenders and recoverswork trajectories over the past few years – which help to explain their current profiles.The theoretical framework includes historical, sociological and legal literature. The methodologicalframework is quantitative, including several descriptive techniques, measuresof centrality, dispersion and analysis of distributions. The results show that the defenders’profiles and trajectories reflect the important process of institutional valorization(or strengthening) of Public Defenders’ Offices in the last decades in Brazil.

Esses indivíduos adquiriram grande relevância após a Constituição Federal de 1988, como promotores de direitos fundamentais de extensas parcelas da população brasileira. Parcelas que sempre tiveram dificuldades para acessar as instituições do sistema de justiça – por razões como, por exemplo, a insuficiência de recursos financeiros. A ideia neste artigo é apresentar os perfis sociais e laborais dos atuais integrantes das Defensorias Públicas, bem como recuperar as suas trajetórias laborais ao longo dos últimos anos – trajetórias que podem ajudar a explicar os seus perfis atuais. O referencial teórico utilizado para a compreensão dos perfis e das trajetórias dos defensores públicos é essencialmente interdisciplinar, estando ancorado na literatura histórica, sociológica e jurídica. Já o referencial metodológico usado para delinear tanto os perfis quanto as trajetórias é de natureza quantitativa, incluindo técnicas de análise de tipo descritivo, bem como medidas de centralidade, dispersão e formato de distribuição.
