“Formerly incarcerated migrant women’s project”: a civil society organization work experience with migrant women in conflict with the law in the city of São Paulo

Resumo: This article aims to present the work experience of Formerly Incarcerated Migrant Women’s Project, of the Land, Work and Citizenship Institute (ITTC), which is focused on the direct assistance to migrant women who left the penitentiary system in São Paulo. The proposal is relating the Project’s work experience with migrant women who were involved with the brazilian penal system with the changes provided by the new brazilian Migration Law (Law 13.445/2017), in addition to the discussion about access to rights and public services and policies in the new set that comes with more migrant women responding to criminal prosecutions and serving sentences outside the prisons. If on the one hand the measures taken in order to avoid the incarceration of migrant women represent an undeniable achievement, on the other hand, the release of the prison does not necessarily represent full access to freedom, bringing a series of new issues to be faced in everyday life.

Se propone, de esta forma, relacionar la experiencia de trabajo del proyecto con las mujeres migrantes implicadas con el sistema penal brasileño con los cambios que aporta la nueva Ley de Migraciones (Ley 13.445/2017), además de debatir el acceso a los derechos, servicios y políticas públicos en el nuevo escenario que se conforma con cada vez más mujeres migrantes que responden a procesos penales y cumplen penas fuera del sistema penitenciario. Si bien las medidas adoptadas para la excarcelación de las mujeres migrantes representan un logro innegable, la salida de la cárcel no necesariamente representa el pleno acceso a la libertad, sino que trae consigo una serie de nuevas cuestiones que deben abordarse a diario.O presente artigo tem o objetivo de apresentar a experiência de trabalho do Projeto Migrantes Egressas (PME) do Instituto Terra, Trabalho e Cidadania (ITTC), que tem como escopo o atendimento direto com mulheres migrantes egressas do sistema prisional paulista. Propõe-se assim relacionar a experiência de trabalho do projeto junto às mulheres migrantes envolvidas com o sistema penal brasileiro com as mudanças proporcionadas pela nova Lei de Migrações (Lei 13.445/2017), além de discutir o acesso a direitos, serviços e políticas públicas no novo cenário que se conforma com cada vez mais mulheres migrantes respondendo processos criminais e cumprindo penas fora do sistema prisional.
