Persistent land tenure conflicts and violent evictions in Brazil

Resumo: The article discusses the persistence of land tenure conflicts and violent evictions in Brazil from a historical perspective. By focusing on the legislative evolution concerning protection for the right to housing and the right to the city, and identifying advances in the Code of Civil Procedure and in resolutions from the National Human Rights Council, the analysis reveals that such issues persists not due to legislative omission, but due to a legal and political culture protecting the right to property that is deeply ingrained in the Brazilian Judiciary. It also investigated the extraordinary measures taken during the COVID-19 pandemic by the CNJ and the STF to avoid collective evictions during this period. In conclusion, the complexity of collective land tenure conflicts require from institutions a new perspective on the issue, or we may continue to witness the tragedy of human rights violations in violent evictions.

A análise se debruça sobre a evolução legislativa da proteção do direito à moradia e do direito à cidade, bem como identifica avanços no Código de Processo Civil e em resoluções do Conselho Nacional de Direitos Humanos para demonstrar que o problema persiste não em função de omissão legislativa, mas de uma cultura jurídica e política protetiva do direito de propriedade bastante incrustada no Poder Judiciário brasileiro. São analisadas, ainda, as medidas extraordinárias tomadas durante a pandemia da Covid-19 pelo Conselho Nacional de Justiça (CNJ) e pelo Supremo Tribunal Federal (STF), a fim de evitar despejos coletivos durante esse período.
