Resumo: | The article discusses the persistence of land tenure conflicts and violent evictions in Brazil from a historical perspective. By focusing on the legislative evolution concerning protection for the right to housing and the right to the city, and identifying advances in the Code of Civil Procedure and in resolutions from the National Human Rights Council, the analysis reveals that such issues persists not due to legislative omission, but due to a legal and political culture protecting the right to property that is deeply ingrained in the Brazilian Judiciary. It also investigated the extraordinary measures taken during the COVID-19 pandemic by the CNJ and the STF to avoid collective evictions during this period. In conclusion, the complexity of collective land tenure conflicts require from institutions a new perspective on the issue, or we may continue to witness the tragedy of human rights violations in violent evictions. |
