Punishment and zero tolerance:: from the social state to the penal state and the consequences in Brazilian reality

Resumo: This paper aims to understand, through the study of authors such as Loïc Wacquant and Jock Young, about the transition from the Social State to the Penal State, how the evolution of the punishment and the policy of zero tolerance occurred, and how these factors have consequences in the Brazilian reality. The purpose of this study is to analyze the relationship between economic policy, social structure and criminal policy, and then to verify the extent to which the zero tolerance policy was imported from the United States to Brazil in order to produce effects on the policy criminal and directly reflect on the Brazilian prison system. The method used is the deductive, through a bibliographical analysis and statistical data.

Se pretende, de este modo, analizar las relaciones existentes entre política económica, estructura social y política criminal, para así verificar en qué medida la política de tolerancia cero fue importada de Estados Unidos a Brasil, con el fin de producir efectos sobre las direcciones de la política criminal y reflejar directamente en el sistema penitenciario brasileño. El método utilizado es el deductivo, mediante un análisis bibliográfico y de datos estadísticos.O presente trabalho tem como objetivo compreender, por meio do estudo de autores como Loïc Wacquant e Jock Young, a respeito da transição do Estado Social ao Estado Penal, como se deu a evolução da penalidade e da política de tolerância zero, e de que maneira esses fatores geram consequências na realidade brasileira. Pretende-se, assim, analisar as relações existentes entre política econômica, estrutura social e política criminal, para então verificar em que medida a política de tolerância zero foi importada dos Estados Unidos para o Brasil, de forma a produzir efeitos sobre os rumos da política criminal e refletir diretamente no sistema prisional brasileiro.
