The Federal Penitenciary System and the violation of prisioner’s rights:: a critical reflection of the selection criteria of Brazilian enemies of the states

Resumo: This paper intends to examine the violation of individual rights of prisoners included in the Federal Prison Department. Although the parameters of inclusion and transfer of inmates to federal penitentiaries are provided for by the Law nº 11.671/2008 and the art. 3º of Decree 6.877/2009, there is no clear definition that objectively delimits the cases of submission to the new regime. In this sense the failure of strict legality on the normative fixation of such cases, combined with the characteristics of federal prisons themselves, generates constant violation of prisoners’ individual rights. It is, therefore, another form of expressing the Enemy Criminal Law in the Brazilian legal system.

Aunque los criterios de inclusión y traslado de presos a las penitenciarias federales están previstos conjuntamente en la Ley nº 11.671/2008 y en el artículo 3 del Decreto nº 6.877/2009, no hay definición precisa que delimite objetivamente los casos de sometimiento al nuevo régimen. En este sentido, la inobservancia de la legalidad estricta en la fijación normativa de dichas hipótesis, unida a las propias características de los centros penales federales, hace constante la violación de los derechos individuales de los presos. Se trata, pues, de otra forma de expresión del derecho del enemigo en el ordenamiento jurídico brasileño. O presente artigo aborda a violação dos direitos individuais do preso incluído no Sistema Penitenciário Federal. Embora os critérios de inclusão e transferência de presos para as penitenciárias federais estejam previstos conjuntamente na Lei nº 11.671/2008 e no art. 3º do Decreto nº 6.877/2009, não há definição precisa que delimite objetivamente os casos de submissão ao novo regime. Nesse sentido, a inobservância da legalidade estrita na fixação normativa das referidas hipóteses, aliada às próprias características dos estabelecimentos penais federais, torna constante a violação aos direitos individuais dos presos. Trata-se, portanto, de mais uma forma de expressão do direito do inimigo no ordenamento jurídico brasileiro.
