Resumo: This case study analyzes the judgment of the Inter-American Court of Human Rightsin the Hernández vs. Argentina. The Court, reiterating its understanding that economic,social, cultural and environmental rights are autonomous and vindicating at the domesticand international levels, confirmed the recognition of the right to health withinthe framework of the Inter-American Human Rights System, protected by Article 26of the American Convention, the Charter of the Organization of American States andthe American Declaration of the Rights and Duties of Man. The Court recognized theobligation of States-Parties to guarantee the right to health for persons deprived of libertyand under state supervision.

A Corte, reiterando seu entendimento segundo o qual os direitos econômicos, sociais, culturais e ambientais são autônomos e vindicáveis nos planos interno e internacional, confirmou o reconhecimento do direito a saúde no âmbito do Sistema Interamericano de Direitos Humanos, protegido pelo art. 26 da Convenção Americana, pela Carta da Organização dos Estados Americanos e pela Declaração Americana dos Direitos e Deveres do Homem.
