Resumo: The article seeks to understand and single out the concept of gender identity. Amidst the confusion of concepts, prejudice is diffused on the basis of social and moral dogmas. As a form of confrontation, rights education and the intervention of the legal field in the recognition of the right to gender identity as a substrate integral to the dignity of the human person are necessary ways for a democracy that respects the right of minorities. Based on the paradigm of the Inter-American Court of Human Rights, published in Opinion Consultative n. 24/2017, the Federal Supreme Court places itself before another elementary decision to ensure that the process of self-identification develops free of judicial interference that stipulate surgical conditions or other requirements that violate the freedoms enshrined in the Federal Constitution and international treaties of humans rights.

En medio de la confusión de conceptos, el prejuicio se difunde sobre la base de dogmas sociales y morales. Como forma de enfrentamiento, la educación en derechos y la intervención del campo jurídico en el reconocimiento del derecho a la identidad de género como sustrato integral de la dignidad de la persona humana representan caminos necesarios para una democracia que respete el derecho de las minorías. Desde el paradigma de la Corte Interamericana de Derechos Humanos, difundido en la Opinión Consultiva nº. 24/2017, el Supremo Tribunal Federal se enfrenta a otra decisión elemental para garantizar que el proceso de autoidentificación se desarrolle libre de injerencias judiciales que estipulen condiciones quirúrgicas u otros requisitos que violen las libertades consagradas en la Constitución Federal y en los tratados internacionales de Derechos Humanos.O artigo busca entender e singularizar o conceito de identidade de gênero. Em meio à confusão de conceitos, o preconceito se difunde com base em dogmas sociais e morais. Como forma de enfrentamento, a educação em direitos e a intervenção do campo jurídico no reconhecimento do direito à identidade de gênero como substrato integrante da dignidade da pessoa humana representam caminhos necessários a uma democracia que respeite o direito das minorias.
