Resumo: The present work presents the legal concept of "homeless population" and the reason why it is necessary to delimit the legal object for the creation of public policies and with that direct the State in the creation of measures to change the social reality. In addition, it explains what the hostile architecture technique is and that the purpose of its use is to scare away the homeless population of large urban centers with the objective of valuing the properties in their surroundings. Therefore, it was found that the State is co-opted to carry out policies that benefit the wealthiest economic sectors and that Bill No. 488 of 2021 aims to prohibit the use of hostile constructions to prevent access to the city by the population of Street . Finally, it is concluded that the fence is not necessary, but a regulation of these techniques so as not to limit, too much, the right to the city.

Finally, it is concluded that the fence is not necessary, but a regulation of these techniques so as not to limit, too much, the right to the city.Este trabalho apresenta a conceituação jurídica de “população em situação de rua” e o motivo da necessidade de delimitação desse objeto jurídico para a criação de políticas públicas, a fim de direcionar o Estado na criação de medidas para alterar a realidade social. Ademais, explica-se o que é a técnica de arquitetura hostil e que o intuito de sua utilização é afugentar a população de rua dos grandes centros urbanos com o objetivo de valorizar os imóveis em seu entorno. Por conseguinte, constatou-se que o Estado é cooptado para realizar políticas que beneficiam os setores econômicos mais poderosos e que o Projeto de Lei n° 488 de 2021 tem o objetivo de possibilitar o direito à cidade para toda a sociedade, em especial a população em situação de rua. Ainda, verificou-se que há a possibilidade de se utilizar as técnicas de construção hostil por meio de um exemplo. Por fim, concluiu-se que a lei foi necessária para garantir o referido direito, uma vez que ao se utilizar as técnicas hostis para afastar as pessoas em situação de rua, tolhe-se o direito de todos, bem como se constatou que alguns setores econômicos são os mais interessados, já que se beneficiam disso.
