Resumo: | The theme of this article is: Offset contracts: international contracts and the obstacles of Brazilian legislation in the bidding process. The following problem was investigated: Does the Brazilian State have an agenda to mitigate contractual barriers between the international actors involved in the Offset agreements? The following hypothesis was considered: Is there specific legislation designed to accompany the compensation clauses throughout the Offset project? The general objective is: To identify the historical background of the international legislative evolution up to the present. The specific objectives are: To enter the historical points of creation; how it was adapted to the national territory. This work is important for an operator of the Law, for society and science as a whole, because the lack of specific legislation designed to accompany the compensation clauses throughout the Offset project makes the international legislative equalization go beyond the policy budgetary authority conferred on the State. This is a qualitative theoretical research lasting five months. As a result of the research conducted, it is concluded that the Offset is an instrument of political and strategic influence that should not be contained in the military area, the Offset can assist technological and industrial progress as a whole, in the case of the dynamics of each contractual agreement. International practice, it is impracticable to develop a suitable legislative context for the reception of a rigid execution linked to the Offset agreement. |

Se investigó el siguiente problema: ¿El Estado brasileño tiene una agenda para mitigar los obstáculos contractuales entre los actores internacionales involucrados en los acuerdos de compensación? Se consideró la siguiente hipótesis: ¿Existe legislación específica diseñada para monitorear las cláusulas de compensación a lo largo del proyecto Offset? El objetivo general es: Identificar los antecedentes históricos de la evolución legislativa internacional hasta la actualidad. Los objetivos específicos son: Entrar en puntos de creación histórica; cómo se adaptó al territorio nacional. Este trabajo es importante para un operador de Derecho, para la sociedad y la ciencia en su conjunto, ya que la falta de una legislación específica diseñada para acompañar las cláusulas de compensación a lo largo del proyecto Offset hace que la equivalencia legislativa internacional exceda el presupuesto de política asignado al Estado. Se trata de una investigación teórica cualitativa con una duración de cinco meses. Como resultado de la investigación realizada se concluye que el Offset es un instrumento de influencia política y estratégica que no debe ser contenido al ámbito militar, el Offset puede coadyuvar al progreso tecnológico e industrial en su conjunto, en cuanto a la dinámica de cada acuerdo contractual a nivel internacional, se hace impracticable desarrollar un contexto legislativo adecuado para la recepción de una ejecución rígida vinculada al acuerdo de Offset.Il tema di questo articolo è: Appalti in offset: contratti internazionali e gli ostacoli della legislazione brasiliana nel processo di gara. È stato indagato il seguente problema: lo Stato brasiliano ha un'agenda per mitigare gli ostacoli contrattuali tra gli attori internazionali coinvolti negli accordi di Offset? È stata considerata la seguente ipotesi: Esiste una normativa specifica volta a monitorare le clausole retributive durante tutto il progetto Offset? L'obiettivo generale è: Identificare il contesto storico dell'evoluzione legislativa internazionale fino ai giorni nostri. Gli obiettivi specifici sono: Entrare nei punti creazione storici; come è stato adattato al territorio nazionale. Questo lavoro è importante per un operatore del Diritto, per la società e la scienza nel suo complesso, poiché la mancanza di una legislazione specifica volta ad accompagnare le clausole di compensazione durante tutto il progetto Offset fa sì che l'equivalenza legislativa internazionale superi il budget politico assegnato allo Stato. Si tratta di una ricerca qualitativa teorica della durata di cinque mesi. A seguito delle ricerche effettuate, si conclude che l'Offset è uno strumento di influenza politica e strategica che non dovrebbe essere confinato all'area militare, l'Offset può aiutare il progresso tecnologico e industriale nel suo complesso, in termini di dinamiche di ciascun accordo contrattuale a livello internazionale, diventa impraticabile sviluppare un contesto normativo adeguato per la ricezione di una rigida esecuzione legata all'accordo di Compensazione.O tema deste artigo é: Contratos em offset: contratos internacionais e os entraves da legislação Brasileira no processo licitatório. Investigou-se o seguinte problema: O Estado Brasileiro possui agenda para mitigar os entraves contratuais entre os atores internacionais envolvidos nos acordos de Offset? Cogitou-se a seguinte hipótese: Existe uma legislação específica destinada a acompanhar as cláusulas de compensação durante todo o projeto de Offset? O objetivo geral é: Identificar o retrospecto histórico da evolução legislativa internacional até a contemporaneidade. Os objetivos específicos são: Adentrar aos pontos históricos de criação; como foi adequada ao território Nacional. Este trabalho é importante para um operador do Direito, para a sociedade e a ciência como um todo, pois a falta de uma legislação específica destinada a acompanhar as cláusulas de compensação durante todo o projeto de Offset faz com que a equiparação legislativa internacional ultrapasse a política orçamentária conferida ao Estado. Trata-se de uma pesquisa qualitativa teórica com duração de cinco meses.
