Resumo: This article seeks to present an explanation of the civil law and common law systems, in addition to discussing the microsystem for solving repetitive demands and the influence of precedents within it. The objective is to discuss the application of precedents within the system of repetitive demands and to analyze their constitutionality. It is a work developed through qualitative research, using bibliographic references, analysis of doctrines and jurisprudence. It presents a discussion on the constitutionality aspects of the precedents and their influences on the microsystem of repetitive demands of the CPC, addressing the doctrinal understandings about the subject.
