Resumo: The onerosa concession of the right to build is provided for in law 10257 oferece 2001, know as the Statute of Cities. It is a legal institute that aims regulate the use of urban space,  being an important instrument for the development of cities. It occurs when the municipality fixes areas in which the right requests to be exercised above the coefficient of basic utilization fixed by  law with counterpart to be provided by the owner.  The limit for construction  fixed on which  isso built above this limit is applied the institute which consists of a remuneration to the public coffers according to established criteria. The amount collect should be used by the public order in housing projects,  improvement of  urban equipment,  creation of public spaces for leisure and green areas.  It consists of adjusting the investment and the profit of the constructor to the development of the locality, aiming to guarantee  the constitucional right to housing and the balanced environment.

Trata-se de instituto jurídico que visa a regular o uso do espaço urbano, sendo um instrumento importante para o desenvolvimento das cidades. Ocorre quando o município fixa áreas nas quais o direito de construir pode ser exercido acima do coeficiente de aproveitamento básico fixado em lei mediante contrapartida a ser prestada pelo proprietário. Fixado o limite para a construção, sobre o que for construído acima desse limite é aplicado o instituto, que consiste numa remuneração aos cofres públicos de acordo com critérios previamente estabelecidos.
