Resumo: The article in question, intends to address a theme of racial segregation in the United States and Brazil. For closed discussions, to analyze the classic Brown case versus council of education and its reflexes in the American judicial system, in this context, to address will also address a racial issue within the scope of Brazilian society. The article has an essential documentary methodology, based on the literature review. The preliminary results of the reflections, point to the emblematic decision of the American Supreme Court that changes the paradigm “separate, but equal”, declaring an unconstitutional racial segregation in the country. In the Brazilian case, despite racism being considered a non-bailable crime under the 1988 constitution and our ethnic background is mostly black, the spaces of prejudice preserved in the until today

Para fecunda discussão, analisaremos o caso clássico Brown versus board of educacion e seus reflexos no sistema judicial americano, neste contexto, trataremos também de abordar a questão racial no âmbito da sociedade brasileira. O artigo possui uma metodologia essencialmente documental, baseada em revisão de literatura. Os resultados preliminares das reflexões, apontam que a decisão emblemática da Suprema Corte americana altera o paradigma “separados, porém iguais”, declarando a segregação racial inconstitucional no país.
