Resumo: The existence of class actions discussing public policies is a well-known phenomenon triggered by the need to enforce the transformational project brought by the Brazilian Constitution. This text explores the reasons why political decisions translated into public policies came to judicial attention through class actions. The aim is to suggest parameters according to which the challenge of an ongoing public policy should be bring to judicial scrutiny, granting an objective appreciation – and not a mere subjective objection by controllers.

Este texto explora a razões pelas quais decisões políticas traduzidas em políticas públicas vieram à atenção do Judiciário através de ações coletivas.
