Resumo: This article intends to analyze orthothanasia in Brazil and the practice of palliative care, its concept and advantages for patients with terminal illnesses, for whom curative medicine becomes useless, as well as to carry out a brief legal analysis based on the Federal Constitution of 1988 and in the Resolutions of the Federal Council of Medicine (FCM) and in the Code of Medical Ethics (CME). Orthothanasia refers to non-therapeutic intervention aimed at artificially prolonging the life of the terminally ill. To achieve the proposed objectives, a literature review is used as a methodology, based on scientific articles and current Brazilian legislation. Finally, it concludes that orthothanasia and palliative care can be adopted,since there is no legal impediment or offense to any principle established by law.

Finally, it concludes that orthothanasia and palliative care can be adopted,since there is no legal impediment or offense to any principle established by law.O presente artigo pretende analisar a ortotanásia no Brasil e a prática dos cuidados paliativos, seu conceito e vantagens aos pacientes com enfermidades terminais para quem a medicina curativa se torna inútil, bem como realizar uma breve análise jurídica, com base na Constituição Federal de 1988 e nas Resoluções do Conselho Federal de Medicina (CFM) e Código de Ética Médica (CEM). A ortotanásia se refere a não intervenção terapêutica que se destine a prolongar a vida do doente terminal de forma artificial. Mesmo não dispondo de legislação específica, com o advento da Resolução nº 1.805/2006 do CFM ficou mais fácil compreender e aplicar esses cuidados na prática. Para alcançar os objetivos propostos, utiliza-se uma revisão de literatura como metodologia, com base em artigos científicos e legislação brasileira vigente.
