Resumo: Obtaining quality biological products is a procedure that has always concerned the health authorities. The demands on quality blood are an international concern, which demands adequate methods of testing, both clinical and laboratory. The subject of deep reflection, the legal prohibition on the donation of blood by men who have sex with men, is the subject of fervent debate. At present, the Supreme Court will be the definitive voice on the matter. The constitutionality or unconstitutionality of norms that prohibit donation by men who have sex with men, and their partners, will ultimately be the subject of analysis by our higher court. Nevertheless, while the Federal Supreme Court does not manifest itself, it is necessary to analyze the issue objectively, considering the practical aspects of the issue.

As exigências acerca de um sangue de qualidade é uma preocupação internacional, que demanda adequados métodos de testagem, tanto clínica, quanto laboratorial. Tema que se encontra alvo de profunda reflexão, a vedação legal à doação de sangue por homens que fazem sexo com homens, é objeto de debates fervorosos. Na atualidade, será o Supremo Tribunal Federal a voz definitiva acerca da questão. A constitucionalidade ou inconstitucionalidade das normas que vedam a doação por homens que fazem sexo com homens, e as parceiras destes, será, enfim, alvo de análise por nossa Corte maior.
