Resumo: This work aims to analyze the judgment of provisional measures regarding Brazil by the Inter-American Court of Human Rights, subject - Plácido de Sá Carvalho Penal Institute -, Resolution No. 39, November 22, 2018. The following problem is based on the investigation: The offense to human rights endemically in the Brazilian Penitentiary System and the State of Things Unconstitutional and the imprescindibility of the Trial by the International Courts to change the social structure and government institutions at the internal level on issues involving respect for human rights in the Brazilian prison system.
