It is found that, in Brazil, despite being already covered by the environmental standards in force, popular participation is limited to specific times of the environmental permitting procedure, weakening its role of supporting decision-making by the Government and making it difficult to adopt socially and environmentally fair measures. One of the assumptions of a Democratic and Environmental Rule of Law is that citizens have the right (and duty) to actively participate in decision making that may affect environmental balance. The research used, in addition to the legal-comparative method, the legal and propositional one in order to suggest the necessary improvements and the expansion of the participation instruments in the environmental assessment evaluation procedures in the Brazilian legal system through the analysis of foreign environmental standards.Editora Dom Helder2016-05-10info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionapplication/pdfhttp://revista.domhelder.edu.br/index.php/veredas/article/view/68210.18623/rvd.v13i25.682Veredas do Direito; Vol. 13 No. 25 (2016): Veredas do Direito – Direito Ambiental e Desenvolvimento Sustentável; 69-91Veredas do Direito; Vol. 13 Núm. 25 (2016): Veredas do Direito – Direito Ambiental e Desenvolvimento Sustentável; 69-91Veredas do Direito – Direito Ambiental e Desenvolvimento Sustentável; v. 13 n. 25 (2016): Veredas do Direito – Direito Ambiental e Desenvolvimento Sustentável; 69-912179-8699reponame:Veredas do Direito (Online)instname:Escola Superior Dom Helder Câmara (ESDHC)instacron:ESDECenghttp://revista.domhelder.edu.br/index.php/veredas/article/view/682/476Copyright (c) 2016 Veredas do Direito: Direito Ambiental e Desenvolvimento Sustentávelinfo:eu-repo/semantics/openAccessThomé, RomeuRibeiro, José Cláudio Junqueira2020-09-21T11:45:59Zoai:revista.domhelder.edu.br:article/682Revistahttp://revista.domhelder.edu.br/index.php/veredasPRIhttp://revista.domhelder.edu.br/index.php/veredas/oaiveredas@domhelder.edu.br2179-86991806-3845opendoar:2020-09-21T11:45:59Veredas do Direito (Online) - Escola Superior Dom Helder Câmara (ESDHC)false
