Resumo: This article aims to explain why the limitation by values in the classification of the labour credits in the bankruptcy is a good measure to the market and to the society, Through the method of solving real law antinomies by law and economics perspective it is tried to understand the consequences that the decision will inflict on the society, as well as their externalities and the efficiency, based on the controversy of the limitation of labor credits on company bankruptcy. Methodologically the article was based on bibliographic research and on the jurisprudence of the Federal Supreme Court. It was concluded that, in the light of the Economic Analysis of Law, the limitation on labor claims in the Bankruptcy Law must be respected, otherwise it willhappen a distortion of the entire system.

A partir do método de resolução de antinomias reais sob a ótica da Análise Econômica do Direito, buscam-se aquilatar as consequências que determinada decisão irá impor à sociedade, bem como suas externalidades e a eficiência, baseados na polêmica da limitação à preferência dos créditos laborais na falência da empresa. Metodologicamente o artigo se valeu de pesquisa bibliográfica e da jurisprudência do Supremo Tribunal Federal.
