Initial effects of labor reform from the perspective of law and economics and the Welfare State

Resumo: The Welfare State presents itself as a model of political and economic organization that presents social and economic policies adopted by the State with the aim of improving the living conditions of citizens and reducing social inequality. In the national context, an important milestone of this policy was the Consolidation of Labor Laws, enacted in 1943. However, with the need for greater economic competitiveness, the demand for a change in the legislation on labor relations arose. Thus, Bill No. 6,787 in 2016, which resulted in the publication of Law No. 13,467 in July 2017, known as the Labor Reform, modified these rules. In this sense, the objective is to analyze the main changes promoted by the reform and its initial effects on the CLT. The study adopts the deductive method, using a bibliographic review. There is a weakening of labor legislation that does not refer to the Social Welfare State.

Inobstante, com a necessidade de maior competitividade econômica, surgiu a demanda por uma modificação na legislação das relações de trabalho. Assim, o Projeto de Lei nº 6.787 em 2016, que resultou na publicação da Lei nº 13.467 em julho de 2017, conhecida como a Reforma Trabalhista, modificou estas regras. Neste sentido, objetiva-se a analise das principais alterações promovidas pela reforma e seus efeitos iniciais na CLT. O estudo adota o método dedutivo, utilizando revisão bibliográfica.
