JUDICIAL POWER AND LAND CONFLICTS: NEW PATHS TO ENFORCE RIGHTS FOR VULNERABLE POPULATIONS

Resumo: During the Covid-19 pandemic, thousands of families suffered forced removals from the countryside and cities. In this context, social movements filed lawsuits and appeals with the Federal Supreme Court with the aim of suspending forced removals. In 2023, the National Council of Justice issued Recommendation 510 providing for the creation of Land Solutions Commissions by the Courts. The article explores, through a bibliographical review, analysis of legal processes and recommendations from the Justice System, the possibilities open for the construction of a new legal culture in land conflicts.

The article explores, through a bibliographical review, analysis of legal processes and recommendations from the Justice System, the possibilities open for the construction of a new legal culture in land conflicts.Durante a pandemia da Covid-19, milhares de famílias sofreram remoções forçadas do campo e das cidades.  Nesse contexto, movimentos sociais ingressaram com ações e recursos no Supremo Tribunal Federal com o objetivo de suspender as remoções forçadas. Em 2023, o Conselho Nacional de Justiça editou a Recomendação nº 510 prevendo a criação de Comissões de Soluções Fundiárias pelos Tribunais.
