Summary: This research tries to establish the relationship between Intellectual Property and Innovation, through a comparative study of the laws of Brazil and France, seeking to reveal the importance and feasibility of complementarity between the two cases, as well as showing the protection of these two niches resulted in the development technology of each country. As to the objectives seek to perform a comparative study of Brazilian law and French law relating to intellectual property, and more specifically the Industrial Property and its relation to the creation of new technologies. Resulting from these objectives comes a third, which is devoted to the study of comparative law in regard to innovation, so that we can understand and appreciate why the different levels of technological development. In the second stage, after the final step comparative regarding forms of intellectual property protection and innovation, will be conduct a detailed analysis of the locations in which production occurs innovation, so that at last, using this data may be listed the reasons why France to have a better technological development than Brazil. Regarding the methodology will be developed through the inductive method, based on research literature and documents, which will be used legal material on Intellectual Property and Technological Innovation, and the use of the relevant legislation relating to the theme of the two countries.

Quanto aos objetivos buscaremos realizar um estudo comparativo entre a legislação brasileira e a legislação francesa referente à Propriedade Intelectual, e de forma mais específica a Propriedade Industrial e sua relação com a criação de novas tecnologias. Decorrente destes objetivos surge um terceiro, o qual está voltado para o estudo comparativo da legislação no tocante à inovação, para que se possa compreender e avaliar o porquê dos níveis diferenciados de desenvolvimento tecnológico. Em segundo momento, depois de finalizada a etapa comparativa, no que tange às formas de proteção da propriedade intelectual e inovação, realizar-se-á a análise detida dos locais em que ocorre a produção da inovação, para que, finalmente, utilizando esses dados possam ser elencados os motivos que levaram a França a possuir um melhor desenvolvimento tecnológico que o Brasil.
