Resumo: The present article has by meaning to discuss the question related to the right of construction and to the assured rights in face of the legislation and administration alterations amplify the incidence and protection of the environment. It seems right the confusion made between the assured right and expectation of right. Besides that, there are extremes positions in the sense that environmental rights go over assured rights and vice-versa. Although, we understand it is possible to harmonize the application of assured rights and environmental rights, distinguishing the possibilities where there is a expectation of those where actually have a assured right.

Parece-nos corrente a confusão que se faz entre direito adquirido e expectativa de direito. Além disso, há posições extremadas no sentido de que o direito ambiental prevalece sobre direito adquirido e vice-versa.
