Pretrial detention, racism and criminal selectivity: a discussion from the records of a prison unit

This article aims to discuss how the practices of temporary imprisonment occur. In particular, analyzing the punitive mechanisms that can act in a racist way, in accordance with the idea of penal selectivity. To carry out this debate, the profile of inmates was analyzed within a prison unit for temporary prisoners in the city of Salvador/BA. A representative sample of the records of the inmates of this prison between the years 2017 and 2018 was constituted. The results confirm the findings in the literature that state that the criminal justice system acts in a selective and repressive manner, based on racism. We found that, in the case studied, provisional imprisonment applies expressively to young, black, with little education, subject to precarious work,who commit low value crimes and related to accusations of property crimes and drug trafficking. Comparing the charges against black and non-black people, we found evidence that in the cases of property crimes and drugs the estimated monetary values were significantly lower for black people.
