The Municipal Guards according to the Municipal Chamber of São Paulo: an institution in dispute

Resumo: This article seeks to comprehend how the local legislative, in this case, the Municipal Chamber of São Paulo, legislates in regarding to the attribution and the institutional role of the Municipal Guards, considering a context of dispute about the participation of the Municipality in public security. Through the use of grounded theory (GT), we analyze the bills and their justifications presented in the chamber during the 17 legislature (2017 to march 2020), that had the Municipal Guards as their object. We argue that, despite constitutional provision, it has been occurring, in the past decades, a process of enlargement of the institutional functions of the guards. The Municipal Guard would now act as a protector of the municipal patrimony, as well as communitarian police, preventing crime from happening, and ostensive police, repressing crimes.

Por meio de análise da literatura do campo, aliada à utilização do método da Teorização Fundamentada nos Dados (TFD), foram examinados os projetos de lei e as justificativas apresentados na casa legislativa durante parte da 17ª legislatura (2017 a março de 2020) que tinham como objeto as guardas municipais.
