One hundred years of prohibitionism in Brazil: a neo-institutionalist analysis of drug policies

Resumo: The article historically analyzes drug policy in Brazil, and part of Decree-Law 4.294 of July 14, 1921, which inaugurated prohibitionism in the country and will complete 100 years in 2021. From a theoretical and methodological perspective of the neo-historical institutionalism, it is argued that the trajectory of public drug policies in the country is dependente on the legacy established by the aforementioned prohibitionist decree, which established a mixed system (public and private) of assistance to drug addicts. In addition to the aforementioned decree, drug policies of the military period, Sisnad and current drug law in force, Decree nº 9.761, of April 11, 2019, were analyzed. Based on chronicles, articles and oficial documents were reconstructed the historical moments in which such policies were enacted. It is concluded that consequences of this inheritance lei in the emergence and strengthening of civil Society institutions (private clinics and therapeutic communities) that, over time, started to be financed by federal government, to the detrimento of SUS.

A partir de um recorte teórico-metodológico do neo-institucionalismo histórico, argumenta-se que a trajetória das políticas públicas de drogas no país é dependente do legado estabelecido pelo decreto proibicionista mencionado, que estabeleceu um sistema misto (público e privado) de assistência aos dependentes químicos. Além do referido decreto foram analisadas as políticas de droga do período militar, o Sisnad e atual lei de droga em vigência, o Decreto nº 9.761, de 11 de abril de 2019. Com base em crônicas, artigos e documentos oficiais foram reconstituídos os momentos históricos em que tais políticas foram promulgadas.
