Indirect access to higher education: decisions of state courts of justice

Resumo: | This article analyzes legal decisions for entry into higher education, seeking to identify the majoritarian understanding of the courts of justice in Mato Grosso do Sul and Rio de Janeiro regarding demands based on the scores obtained by candidates in the Exame Nacional do Ensino Médio [National High School] – Enem. These state courts were chosen because they deal with most decisions on the subject. This research is both quantitative and qualitative. There was broad legal concession, with the use of arguments that contradict the rules on age limits for granting certification, as well as a disregard for the democratizing objectives of the act which is part of the policies of access to higher education for young people and adults. It is inferred that the courts have promoted an indirect way to access higher education. |

It is inferred that the courts have promoted an indirect way to access higher education.Se analizan decisiones judiciales relativas al ingreso en la educación superior, buscando identificar el entendimiento mayoritario de los Tribunales de Mato Grosso do Sul y Rio de Janeiro sobre demandas en base a la nota obtenida en el Exame Nacional do Ensino Médio – Enem. Se justifica la opción por estos tribunales porque ellos concentran la mayor parte de las decisiones sobre la temática. Se trata de una investigación cuanti-cualitativa. Se observó una amplia concesión judicial, con el uso de argumentos que contrarían las normas de limitación de edad para la concesión de la certificación, así como desconsideran los objetivos democratizantes de tal acción integrante de las políticas de acceso a la educación superior para jóvenes y adultos. Se infiere que los tribunales promovieron un acceso oblicuo a la educación superior.Les conditions judiciaires qui ont pour objet l’admission dans l’enseignement supérieur sont analysées , en cherchant à identifier l’entendement majoritaire de tribunaux des états de Mato Grosso do Sul et de Rio de Janeiro à propos des demandes ayant pour la base le notes obtenues par le Exame Nacional do Ensino Médio [Examen National de l’Enseignement Moyen] – ENEM. L’option de ces tribunaux est justifiée par la concentration de la plupart des décisions à ce sujet. Il s’agit d’une recherche quali-quantitative. Une concession judiciaire étendue est observée , avec l’usage d’arguments qui vont à l’encontre des normes de limitation d’âge pour la concession de la certification, et qui ne prennent pas en compte les objectifs démocratiques de cette action intégrante des politiques d’accès à l’enseignement supérieur pour les jeunes et les adultes. On infère que les tribunaux ont promu un accès oblique à l’enseignement supérieur.Analisam-se decisões judiciais que versaram sobre ingresso na educação superior, buscando identificar o entendimento majoritário dos Tribunais de Mato Grosso do Sul e do Rio de Janeiro a respeito de demandas com base na nota obtida pelo Exame Nacional do Ensino Médio – Enem. Justifica-se a opção por esses tribunais por concentrarem a maior parte das decisões sobre a temática. Trata-se de pesquisa quanti-qualitativa. Observou-se ampla concessão judicial, com o uso de argumentos que contrariam as normas de limitação de idade para a concessão da certificação, assim como desconsideram os objetivos democratizantes dessa ação integrante das políticas de acesso à educação superior para jovens e adultos.
