Resumo: In view of the evolution of society and the diversity of each individual, the present work aims to demonstrate the particularities of gender identity, with a special focus on transsexual children and the possibility of sexual reassignment of these people. Based on gender understandings, it turns out that addressing transsexuality is even more complex when it comes to people considered incapable in the light of the legal system. As a result, the procedures and treatments for sexual reassignment are still very carefully analyzed. In this sense, it is necessary to understand that in addition to civil incapacity, people are endowed with progressive autonomy, including children and, along with the right to gender identity, deserve special caution in order to have this right guaranteed, in line with the rights of the personality and dignity of the human person.

A partir das compreensões de gênero, verifica-se que abordar a transexualidade é ainda mais complexo quando se trata de pessoas consideradas incapazes à luz do ordenamento jurídico. Em razão disso, ainda é analisada com bastante cautela a realização dos procedimentos e tratamentos para redesignação sexual.
