Resumo: The national legal system, in a way to protect creditors in good faith and, respectively, their credit before the debtor, created a procedural expedient in order to intervene and solve the problem of satisfaction of the obligation. This file is called “Forced Executive Action”, or just “Civil Execution”. By means of this legal remedy called “Action of Forced Execution” - or hereinafter referred to as “Execution” – the debtor is subject to the legal acts of the State, so that the debt before the creditor can be remedied. A brief comparison is made to the relational obligation between the creditor and the debtor only, in which the parties would have free autonomy to agree on the payment of the object of the obligation, a fact that no longer occurs in Execution

A esse expediente, impõe-se o nome de “Ação Executiva Forçada”, ou apenas “Execução Civil”. Por meio deste remédio jurídico chamado “Ação de Execução Forçada” - ou doravante denominado “Execução” – o devedor se sujeita aos atos jurídicos estatais, para que possa ser sanado o débito perante o credor.
