Resumo: | The article focuses on the deneutralization of the judicial branch, a universal process seen as implying a redefinition of the canonical formula of separation of powers. According to the author, this is a consequence of the changes in the relations between state and civil society in modern capitalism, two dimensions of which are examined in particular. The first is the invasion of law by politics brought about by the advent of the welfare state, where politics is a privileged arena in the struggle for new rights. The second is the incursion of law into politics, associated with constitutionalism, where the judicial branch imposes itself as a new agent in political and legislative activity through its control of the constitutionaly of laws. |

Ela se daria, segundo o autor, como desdobramento de transformações nas relações entre Estado e sociedade civil, operadas no capitalismo moderno, das quais duas dimensões são tratadas em particular. A primeira é a da invasão do direito pela política, característica da afirmação do Welfare State, na qual a política se constitui em arena privilegiada das lutas por novos direitos.
