The “organized crime”: a strange concept to the argentinian criminal law

Resumo: Concepts like “criminal organization” or “organised crimes” are, today, the talk of the town. When we study the field of “organised crimes”, we do not have a concept under study as a starting point. On the contrary, the real aim of a study on “organised crime” is to establish what it is about. The aim of this research is to analyse the international outlined concept, under the assumption that it is an Americanisation of a criminal police against drugs, which through different normative bodies, such as international conventions, has been receipted in different systems of law. In turn, this concept coexists with other pre-existing ones in national laws, specifically the one of “conspiracy”. This coexistence is not harmonic and creates, in fact, many complications. This paper has been developed following qualitative methods of research and the content analysis.

Al investigar en materia de “crimen organizado”, no contamos con un concepto, en tanto objeto de estudio, como punto de inicio. Por el contrario, el verdadero propósito de un estudio sobre “crimen organizado” es establecer “¿de qué se trata?”. Objeto de la presente investigación será analizar el concepto esbozado a nivel internacional, partiendo de la hipótesis que el mismo es una americanización de una política criminal contra la droga, que, a partir de diversas instancias normativas, específicamente a través de convenciones, ha tenido recepción en legislaciones de naturaleza diversa. A su vez, ese concepto, convive, cuando no colisiona, con otros preexistentes en las legislaciones nacionales, específicamente, el de asociación ilícita, asociación criminal o asociación para delinquir. Esta convivencia no es armónica y genera, en la práctica, no pocas complicaciones.
