Employee inventions in Brazil: analysis of the current legislation and change proposals

Resumo: This paper addresses the employer-employee relationship under the new Industrial Property Law, which brings new provisions about this subject, many of them complicated by themselves, as is the case of employeeemployer co-ownership. The paper discusses the incentives created in Germany, Japan and other countries that established specific mIes for employed inventors, granting them the right to receive monetary compensations from their employers, besides their wages. The diversity of criteria adopted by different countries with an outstanding role in science and technology proves the importance of this kind of incentive. The paper analyzes the Brazilian legal provisions and presents a few suggestions of changes to the current legislation, so that it ceases to be a registry instrument, which only assures invention ownership, becoming an effective incentive instrument for the production of relevant inventions.

O texto discute os incentivos instituídos na Alemanha, Japão e outros países que estabeleceram normas específicas para os inventores empregados, conferindo-Ihes o direito de receber compensações monetárias de seus empregadores, independentemente do salário. A diversidade de critérios utilizados em diversos países com destacada atuação em ciência e tecnologia para determinar as compensações aos empregados inventores atesta a importância dessa forma de incentivo.
